Chile Free Trade Agreement (FTA) Professional Visa

Chilean nationals are eligible for the H-1B1 FTA Professional Visa (multiple-entry, 18-month validity) following implementation of the United States – Chile Free Trade Agreement on January 1, 2004.

Eligibility: * The applicant must be engaged in a specialty occupation and attained a post-secondary degree involving at least four years of study in the applicant’s field of specialization.

* A U.S. employer has to furnish a job letter specifying position details and confirming the employment offer. The U.S. employer must also provide a certified form ETA 9035 or 9035E from the U.S. Department of Labor.

* The applicant cannot be self-employed or an independent contractor.

* The period of employment in the United States must be temporary.

Documentation:
  • 1) A Nonimmigrant Visa Application (DS-156).
  • 2) A Supplemental Nonimmigrant Visa Application Form (DS-157) (only for men between 16 and 45 years of age).
  • 3) A passport with a validity date at least six months beyond the applicant’s intended period of stay in the United States.
  • 4) A color or black and white photograph, size 5 x 5 cms.
  • 5) A paid receipt for the US$100.00 visa-processing fee.
  • 6) Verification of requisite qualification to include proof of university graduation and relevant job experience.
